Hello, Is there anyone who could give me information in english. I know a little german. Please help. My ex-wife (German) has not let me seen my daughter in 5 years. ;( I'm an american, living in Germany, working for the US Government. Yes I pay my support (Child, Spouse) 1,000 € per month. :knockout: Thank you.
Matt
High Matt,
welcome to vatersein.de, the WebSite for native english speaker too. 😉
First, be gentle with our english - maybe it's nearly bad as your german 🙂
§ 1684 BGB (citizen law book) says, you have the obligation to see your daughter and your daughter has the right. Further the mother has to promote the contacts.
Call the Jugendamt and ask them for help. They will invite you and your ex for a discussion. If your Ex blocks oder ignores the agreement you have to go to the court. Search for a good attorney, at best a specialist for "Familienrecht". This will take time, sure. But if you first go to the court the will ignore you, because you have not tried to get a solution without the court.
That you pay support has nothing to do with seeing your daughter. This right is owned by you if you pay or not.
Good luck and tell us your results from time to time.

Thank you for a quick reply. I have been in the court for 5 years. The last decision was in the OLG-Karlsruhe. Since my ex-wife brought a paper from the Public Health that say that my daugher is in a bad psy health, that the expert that the court ordered to talk to her, cannot.. And I cannot see her till she's 10 (Dec 06). Than since she lives in Hameln, I have to start a new case up there. My ex has not done what she was told by the court and the OLK is so tired of this till they just passed this on to someone else. Now I have to get my lawyer, (charges an arm and leg), to start something in Hamlen. Is there one here in Stuttgart, or maybe someone know's one in Hameln? There's more to this, but this is the short story. :mouse: Thanks for listening.
Hello Matt,
would you pls. provide us with the wording of the OLG Karlsruhe ruling (anonymize the names) ? A paper from the public health (Amtsarzt?) can't overrule a court's decision to assign an expert. What did the court tell your ex that she didn't do? As for a lawyer, better get a new one who lives in or close to Hameln, it is often of utmost importance that the lawyer knows the behaviour schemes of the judge/judges with whom his clients and he must deal. Maybe you want to get in touch with this lawyer: http://www.machulla-notthoff.de/machulla.htm
